POKOMINX AUTHOR AGREEMENT

DEMO / SAMPLE AGREEMENT

Important Notice:
This document is provided solely to help prospective authors understand the general structure, sections, and key subjects covered in the PokominX Author Agreement.
This is NOT a Final Agreement and does not create any contractual relationship between PokominX and any author.
The Final Agreement will be prepared separately based on the author's verified information and will be sent through PokominX's official email.

PARTIES TO THE AGREEMENT

The Final Agreement will be entered into between:

FIRST PARTY — THE PLATFORM

Designation: Digital Publishing Platform
Operational Nature: Remote / Online-based Platform, Bangladesh

SECOND PARTY — THE AUTHOR
The Final Agreement will contain the author's verified:

  • Full Legal Name
  • Pen Name / Alias, if any
  • Permanent Address
  • Identification Information
  • Email Address
  • Contact Number

Personal information is intentionally omitted from this Demo.

1 PREAMBLE & ACKNOWLEDGMENT

The Agreement will establish the terms under which an author may contribute literary works to the PokominX Digital Publishing Platform.
By entering into the Final Agreement, the Author will acknowledge that they have read, understood, and accepted the applicable PokominX Platform Policies, Author Guidelines, and Submission Procedures.

ARTICLE 1: SCOPE OF WORK & SUBMISSION PROCESS

This section of the Final Agreement will describe:
1.1 Submission Method
The Author will submit their stories or literary works through the official PokominX Author Panel according to the platform's current submission procedure.
1.2 Publication & Review
All submitted content will be reviewed by the PokominX team for compliance with applicable platform policies and publication requirements.
Content will not be published before the review process is completed.
1.3 Publication Process
Approved works will be published on the PokominX platform according to the platform's publication system and applicable guidelines.

ARTICLE 2: COPYRIGHT, OWNERSHIP & NON-EXCLUSIVITY

2.1 Originality Guarantee
The Author will confirm that all submitted works are their own original creations and that they have the necessary rights to submit and publish the works.
The Author will remain responsible for any copyright infringement, plagiarism claim, or ownership dispute arising from their submitted work.
2.2 Intellectual Property
The core copyright and ownership of the written literary work will remain with the Author.
PokominX will receive the necessary non-exclusive rights to digitally display and distribute the work through its platform, subject to the terms of the Final Agreement.
2.3 External Publication Rights
Unless otherwise stated in a separate agreement, the Author will retain the freedom to publish their works on other platforms, provided that such publication does not conflict with the Final Agreement.

ARTICLE 3: CONTENT STANDARDS & PLATFORM RIGHTS

3.1 Content Compliance
All submitted works must comply with PokominX's applicable Content Policy, community standards, and relevant laws.
Prohibited content may include, but is not limited to:

  • Explicit pornography or inappropriate sexual content
  • Hate speech
  • Content intended to promote hatred or violence against a protected group
  • Personal defamation
  • Content that violates applicable laws
  • Copyright-infringing material

3.2 Editorial Rights
PokominX may make necessary minor proofreading, formatting, or editorial adjustments to maintain publication quality, subject to the terms of the Final Agreement.
3.3 Content Removal
PokominX reserves the right to reject, withhold, restrict, or remove content that violates applicable platform policies, guidelines, or contractual terms.

ARTICLE 4: FINANCIAL TERMS, ROYALTIES & PROJECT CONTINGENCY

4.1 Beta Phase & Compensation
The Final Agreement will specify the applicable compensation arrangement during the current Beta/Initial stage of PokominX.
4.2 Revenue / Read-Based Calculation
Where applicable, author compensation will be calculated according to the platform's applicable payment or revenue-sharing policy, including the relevant Read/View data of the Author's published works.
4.3 Payment Intervals
The Final Agreement will specify the applicable payment schedule during the Beta/Initial stage and any future payment schedule applicable after the platform reaches the relevant operational and financial stage.
4.4 Project Contingency
The Final Agreement will contain provisions covering unforeseen circumstances such as major operational failure, shutdown, or discontinuation of the PokominX project.
The applicable rights and responsibilities of both parties in such circumstances will be defined in the Final Agreement.

ARTICLE 5: AGREEMENT MODIFICATION & FUTURE REVISIONS

5.1 Future Agreements
As PokominX develops and expands, the platform may propose a more comprehensive publishing or service agreement where necessary.
5.2 Amendment Protocol
Any modification, amendment, or update to the Agreement will be subject to the applicable procedure and consent requirements specified in the Final Agreement.

ARTICLE 6: TERMINATION & WITHDRAWAL

6.1 Termination
The Final Agreement will specify the conditions and notice period under which either party may terminate the partnership.
6.2 Withdrawal of Published Works
The Final Agreement will specify the Author's rights and the applicable process for requesting the removal of their published works following termination.
The effect of termination on digital publication rights will also be defined in the Final Agreement.
